The legal classification determining whether a worker is covered by workers' comp — employees generally are, while true independent contractors generally aren't.
Why It Matters
Misclassification is a common dispute — being called a '1099 contractor' doesn't automatically mean you're excluded from coverage if you're actually functioning as an employee.
